Estate Planning

Estate Planning is a process for the client to decide how their assets are to be distributed following their death. With proper estate planning, the client can be sure their wishes are fulfilled. Without a proper estate plan, a client’s assets are distributed per statute.

Wills

A Will allows the client to direct how their estate is distributed upon their death. A Will normally requires probate to be filed in the District Court, which increases the time and costs to finalize the distribution of the estate.

Trust

Provides more control for the distribution of an estate without the requirement of Probate.

Power of Attorney

A Power of Attorney will allow a person to appoint a person to act on their behalf if the person is not able to conduct their business.

Advance Directive

An Advance Directive allows the person to provide instructions to their healthcare providers with the end of life instructions if the person is unable to communicate with the health care providers. An Advance Directive helps reduces stress and conflict among family members.

Guardianship

A guardianship is a court proceeding that appoints a guardian to act on behalf of an incapacitated adult or a minor child. The Guardian makes decisions for the incapacitated adult or minor child.

Mediation

Mediation is a process where the parties work through their conflicts with the aid of a mediator. The mediator's job is to assist both individuals in reaching a mutual agreement regarding their disagreement. However, the mediator can not provide legal advice to either party.
